03:07:37 Camille Karlson: YES! 03:07:43 Terrance Keys: Yes! 03:08:42 Jen Snyder SUNY CPD: Please put your questions here in the chat for the end. 03:10:45 Maureen Larsen: This may be addressed during the panel but our main question is this: Our Registrar shared that at the RA Conference, they were told that courses merged at the faculty member's request was a FERPA violation. Would love to get clarity on that. 03:22:10 Casey Jackson: Can you clarify regulatory requirements/expectations around quality improvement projects in the school setting? Specifically, concerning IRB/HRPO determinations that the activities are not research. For instance, clinical QA projects are covered under HIPAA but the expectation is that a β€œnot human subjects research” determination is made to ensure that the project is not research. What does this look like from a FERPA end? Is it expected that educational QI projects also obtain this determination to ensure there isn’t a FERPA violation given that educational QI projects are covered under FERPA? 03:22:45 Laura D Shrader: Reacted to "This may be addresse..." with πŸ‘ 03:26:51 Loy (SUNY GCC): Reacted to "This may be addresse..." with πŸ‘πŸ» 03:27:09 rich mcelrath: I have a FERPA Question. A student wishes to record a professors lecture. They only record the lecture and do their best to not record the full class with others, but it might happen from time to time because of class dynamics. The student may have a documented reason with a DRC office. The instructor may have been notified. Or the student does not with to disclose to anyone and need the recordings. NYS is a one party consent for recording so long as they are part of the party. Can a student continue to record so long as it is for their private use if faculty object that its violation of FERPA or even intellectual property. Does the right to accessibility come first? 03:39:04 Camille Karlson: We have a SUNY-wide contract for the DLE--do we need individual contracts for purposes of the vendor as a school officer? 03:39:40 Caroline Holley: No 03:39:52 Annie Shibata: No. Why DOB? 03:39:56 Jill Nobles: If the student agrees, 03:40:47 Kate Bohan, New Paltz: Is the student registering themself for a third-party vendor considered "written consent?" 03:41:17 Loy (SUNY GCC): Reacted to "Is the student regis..." with πŸ‘πŸ» 03:42:55 Jill Nobles: Can you speak about course merges and how FERPA is involved in that process. Especially in relation to Brightspace where some tools share Student Information between the different sections. 03:43:12 Shubha Kashyap - U. of Michigan: Reacted to "Can you speak about ..." with πŸ‘ 03:43:41 Tonka: Reacted to "Can you speak about ..." with πŸ‘ 03:43:51 Doris O (Adirondack): In the early days of web 2.0 lots of "free" educational apps (especially for K12) would be free because they would collect a lot of data on the students (and for minors, their parents) that was then sold for marketing purposes. 03:44:27 Shubha Kashyap - U. of Michigan: Reacted to "I have a FERPA Quest..." with πŸ‘ 03:45:32 Doris O (Adirondack): If a faculty member teaches at 2 campuses but has only one Brightspace account, is it an issue if FERPA protected information about a student at one campus is sent via the Brightspace email to the faculty email address for the other campus? 03:45:55 Tonka: How about sharing students' emails with other students within a course through an electronic roster. Also, sharing student emails with the course instructor? 03:46:58 Tonka: Email addresses, to be specific 03:47:52 Camille Karlson: If I asked student to use site for educational purposes (mind mapping, polling) and there is no contract and students are asked to create an account that asks for their names and other information, is it correct that this is a FERPA violation. 03:48:26 Caroline Holley: Where on the summit website can we find the links to resources on the last slide of the presentation? 03:48:42 Doris O (Adirondack): Reacted to "Where on the summit ..." with πŸ‘ 03:49:59 Neil Francisco: Reacted to "Can you speak about ..." with πŸ‘ 03:50:12 Jill Nobles: But what about Brightspace that shares emails 03:51:24 Doris O (Adirondack): I'm (still) working on testing where course merges might violate FERPA (where students can see each other from separate courses) so we can look at training faculty to not do something they shouldn't... Hopefully can dive into this again during spring break next week. 03:51:51 Shubha Kashyap - U. of Michigan: Reacted to "I'm (still) working ..." with πŸ‘ 03:52:07 Chrisie Mitchell: WE just said "no convenience merges" just to save me some pain 03:52:30 Jill Nobles: Replying to "I'm (still) working ..." Are you in Brightspace? If so, discussions and emails share info with both sections. On our campus we have told faculty if they merge BS courses they cannot use Email or Discussions. They have to remove the tools. 03:52:54 Jill Nobles: Reacted to "WE just said "no con..." with πŸ‘ 03:53:06 Doris O (Adirondack): Replying to "I'm (still) working ..." Yes, Brightspace. There are ways to avoid issues with discussion and other tools. It's a training issue or as you say just remove the tool. 03:53:29 Jill Nobles: Replying to "I'm (still) working ..." We just tell them it has to be removed or they need consent from all students. It’s really not ideal. 03:53:36 Kate Bohan, New Paltz: Replying to "WE just said "no con..." New Paltz did, too 03:53:57 Maureen Larsen: Thank you Ed. 03:54:38 Maureen Larsen: The more detail on this, the better. Some faculty feel it is okay because it is beneficial to combine the students into a single discussion. We are not sharing rosters with students either. 03:54:53 Chrisie Mitchell: We also turned off rosters for students. 03:56:31 Doris O (Adirondack): Replying to "We also turned off r..." same. but I also let faculty know they should always BCC students when sending emails out to all students. 03:58:16 rich mcelrath: If all of this so pertinent and so relevant why is there not any official guidance posted on SUNY or SUNY RA? How come we all found out second hand through a casual mention in a migration or doodle session? Was this passed to all campus leadership? 04:02:14 Chrisie Mitchell: Unfortunately must go to a union meeting, thank you Alex and company for a great conference as usual! Looking forward to hopefully attending in person eventually! 04:02:30 Doris O (Adirondack): repeat from above: If a faculty member teaches at 2 campuses but has only one Brightspace account, is it an issue if FERPA protected information about a student at one campus is sent via the Brightspace email to the faculty email address for the other campus? 04:03:22 Annie Shibata: Thank you for a wonderful conference! 04:03:50 justin ible: Replying to "Thank you for a wond..." I agree, excited for next years 04:05:36 Camille Karlson: If you're in a hyflex, at point of registration, do the modalities need to be connected and the students declare a modality 04:07:28 Maureen Larsen: Is there a common training resource for faculty to learn about FERPA? 04:07:56 Maureen Larsen: YES PLEASE KIM! 04:07:59 Maureen Larsen: That would be great! 04:07:59 Kate Bohan, New Paltz: YES!
